Client Privacy Policy

As a firm Watkins Tapsell is committed to compliance with the National Privacy Principles (NPP’s) enacted in the Privacy Act 1988, in the way that we collect, use, disclose and manage the personal information you give us.  These principles are additional to our existing duties to you regarding the confidentiality of your personal information under the Legal Profession Act 2004.

The National Privacy Principles give you a right to have access to the personal information we hold about you.  If you wish to have access to that personal information, please contact us.

We initially collect personal information from you for the purpose of assessing whether or not we are in a position to do the work you may ask us to do, and to comply with our obligations under relevant legislation.  If we and you agree that we will do the work, we will use the personal information to carry it out.  Our Legal Services Agreement will identify the work that you asked us to do.

We must identify each of our clients so we will require a copy of photo identification such as your current driver’s licence, passport or Service NSW photo identification.  We must verify each client’s identity for any transactions involving interests in land.  We must also undertake Client Due Diligence in relation to any Designated Services under the Anti-Money Laundering and Counter-Terrorism Financing Act 2006. This involves obtaining additional identity documents from you, gathering information in relation to the relevant transaction, and statements to be signed by you and by us.  This information is part of the personal information we must obtain about you.

The personal information may be disclosed to agents engaged by us on your behalf during the course of your legal matter. It may also be disclosed to relevant government agencies as required by law.

From time to time we may use the personal information to let you know about all of the services that Watkins Tapsell are able to offer to its clients and about events which we may arrange for clients.  We may also ask you to take part in client surveys.

If you instruct us to act on your behalf in relation to a transaction, legal proceedings or legal dispute resolution, the personal information may also be disclosed to other parties.

By instructing us to act, you consent to our use of the personal information as set out in this notice.

We will not otherwise disclose your personal information to an agent or other party without your consent.

If you make a payment using this website, we collect your full name, and your payment number (or invoice). We will only use your card details for processing your payment via our payment partner.

When you are a registered user or where you have given your consent to receive information we may send out from time to time via emails or normal post (for Newsletters, Event Updates etc). We will not divulge your information to third parties.

Keeping your data Secure
We employ security measures to protect your information from access by unauthorised persons and against unlawful processing, accidental loss, destruction and damage. We will retain your information for a reasonable period as long as the law requires.
