Three Child Support Arrangements
There are three main ways child support can be set up in Australia. The right one depends on how straightforward your situation is, how much flexibility you need, and how long you want the arrangement to last.

How the Child Support Formula Works
Services Australia calculates payments using a formula under the Child Support (Assessment) Act 1989 (Cth). Four factors drive the number, which is why two families with similar circumstances can end up with very different assessments.
Combined income
Both parents’ taxable incomes are added together, then a self-support amount is set aside for each parent’s own living costs.
Cost of children
A government table estimates what it costs to raise children at different income levels and ages. That figure becomes the shared pool.
Income share
Each parent’s share of the combined income determines their share of those costs.
Care adjustment
The more time a child spends with a parent, the lower that parent’s payment obligation. Even a modest change in care arrangements can shift which band applies.
Objections, Reviews, and Appeals
If a Services Australia decision doesn’t seem right, you have a clear process to challenge it, but the timeframes are tight, so it’s worth acting quickly.
Objection (within 28 days · free)
A written notice to Services Australia within 28 days of the decision. It’s free to lodge and is the right first step in almost every case.
Tribunal review (within 28 days of the objection decision)
An application to the Administrative Review Tribunal. It’s less formal than court, but having a family child support lawyer prepare your application properly makes a real difference to the outcome. The Administrative Review Tribunal replaced the Administrative Appeals Tribunal in October 2024 and now handles tribunal-level reviews of child support decisions.
Court appeal (questions of law only)
Filed in the Federal Circuit and Family Court of Australia. This is available only where there’s a specific error of law, not simply a disagreement with the decision.
Enforcement of Unpaid Child Support
When support isn’t being paid, it’s not something you should have to chase indefinitely. Services Australia and the courts both have meaningful tools to recover arrears.
Employer garnishee
A direct deduction from the paying parent’s wages, arranged by the Registrar without needing the paying parent’s cooperation.
Tax refund interception
Any income tax refund owed to the paying parent is redirected to cover the outstanding amount.
Centrelink recovery
Arrears can be recovered from Family Tax Benefit or other social security payments the paying parent receives.
Court enforcement
Under the Family Law Act 1975 (Cth), a court can order penalty payments or freeze assets in more serious cases.
