What we do

What Does a Child Support Solicitor in Sydney Do?

Explain Child Support Law

Most parents start with Services Australia, and for many families, that works fine. But the standard formula doesn’t always reflect what’s actually happening in your household, and private agreements need to be drafted correctly to be worth anything.

Our family child support lawyers in Sydney help you understand how the formula applies to your situation, draft and review limited or binding agreements, represent you through objections and tribunal reviews, and take action when support isn’t being paid.

The goal is always the same: make sure your children are properly provided for, with as little conflict as possible along the way.

When to Talk to a Sydney Child Support Lawyer

You don’t need to wait until things get complicated before getting advice. In fact, early guidance from our child support solicitors in the Sutherland Shire usually prevents the bigger problems down the track.

separation in couple with children
01

Separation or divorce

When a relationship ends, child support needs to be sorted alongside everything else. A divorce solicitor in Sydney can help you work through both at the same time, so nothing gets missed.

02

Drafting a private agreement

If you and the other parent want to set your own arrangement rather than follow the formula, the wording matters a great deal. A poorly drafted agreement can unravel when you need it most.

03

Unexpected assessment notice

If Services Australia has issued an assessment that doesn’t look right, because your income has changed, or care arrangements aren’t reflected accurately, you have just 28 days to respond.

04

Income changes for either parent

A new job, a business, redundancy, or a significant pay change can all affect what’s fair. Either parent can request a reassessment when circumstances shift.

05

Disputes about parentage, care or income

If there’s genuine disagreement about who the children live with, what each parent earns, or questions about parentage, those issues need to be properly resolved first.

06

Unpaid child support

If payments have stopped or keep falling short, there are real enforcement options available. Our team can help you use them.

Process

How the Child Support Formula Works

Services Australia calculates payments using a formula under the Child Support (Assessment) Act 1989 (Cth). Four factors drive the number, which is why two families with similar circumstances can end up with very different assessments.

Combined income

Both parents’ taxable incomes are added together, then a self-support amount is set aside for each parent’s own living costs.

Cost of children

A government table estimates what it costs to raise children at different income levels and ages. That figure becomes the shared pool.

Income share

Each parent’s share of the combined income determines their share of those costs.

Care adjustment

The more time a child spends with a parent, the lower that parent’s payment obligation. Even a modest change in care arrangements can shift which band applies.

Objections, Reviews, and Appeals

If a Services Australia decision doesn’t seem right, you have a clear process to challenge it, but the timeframes are tight, so it’s worth acting quickly.

Objection (within 28 days · free)

A written notice to Services Australia within 28 days of the decision. It’s free to lodge and is the right first step in almost every case.

Tribunal review (within 28 days of the objection decision)

An application to the Administrative Review Tribunal. It’s less formal than court, but having a family child support lawyer prepare your application properly makes a real difference to the outcome. The Administrative Review Tribunal replaced the Administrative Appeals Tribunal in October 2024 and now handles tribunal-level reviews of child support decisions.

Court appeal (questions of law only)

Filed in the Federal Circuit and Family Court of Australia. This is available only where there’s a specific error of law, not simply a disagreement with the decision.

Unpaid Child Support

Enforcement of Unpaid Child Support

When support isn’t being paid, it’s not something you should have to chase indefinitely. Services Australia and the courts both have meaningful tools to recover arrears.

Employer garnishee

A direct deduction from the paying parent’s wages, arranged by the Registrar without needing the paying parent’s cooperation.

Tax refund interception

Any income tax refund owed to the paying parent is redirected to cover the outstanding amount.

Centrelink recovery

Arrears can be recovered from Family Tax Benefit or other social security payments the paying parent receives.

Court enforcement

Under the Family Law Act 1975 (Cth), a court can order penalty payments or freeze assets in more serious cases.
